Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and All in Plus LLC, a California limited liability company that operates NurseJames ("All in Plus LLC", "NurseJames", "we", "us", or "our").
These Terms govern your access to and use of nursejamesnclex.com, the learner dashboard, Exam Simulator, Readiness Exam, Review Cards, Study Guides, Video Lessons, Live Class sessions, NCLEX Applications resources, question banks, performance tools, study planning tools, community features, and all related websites, services, content, and functionality we provide (collectively, the "Service").
By creating an account, purchasing or receiving access, or otherwise using the Service, you agree to these Terms. If you do not agree to these Terms, do not access or use the Service.
1. Agreement to these Terms
You accept these Terms when you create an account, purchase or receive access, or otherwise use the Service.
If you use the Service on behalf of a school, employer, institution, or other organization, you represent that you have authority to accept these Terms on that organization's behalf.
Our Privacy Policy is incorporated into these Terms and explains how we collect, use, protect, and disclose personal information.
2. Eligibility
You must be legally capable of entering into a binding contract under the laws applicable to you.
If you have not reached the age at which you may independently enter into a binding agreement in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian.
You may not use the Service where such use would violate applicable law.
3. About the Service
All in Plus LLC provides educational resources intended to help nursing students and nursing graduates prepare for the NCLEX® examination.
Depending on your plan or access level, the Service may include:

- Next Generation NCLEX-style question formats
- Review Cards
- Study Guides
- Video Lessons
- Live Class sessions
- performance and progress tracking
- study planning tools

Available features may vary according to enrollment, subscription level, institutional access, promotional access, or access period.
4. Educational purpose only
The Service is an educational study and review resource.
It does not grant a nursing license, determine eligibility to take the NCLEX, register you for the NCLEX, replace an accredited nursing education program, provide official Board of Nursing advice, provide legal or immigration advice, or guarantee a passing examination result.
We do not guarantee any particular NCLEX score, passing result, nursing license, employment opportunity, immigration result, credential evaluation, or professional outcome.
Clinical content is provided for educational and examination-preparation purposes only. It is not medical advice and should not be relied upon to diagnose, treat, or make actual patient-care decisions.
5. NCLEX and NCSBN disclaimer
NCLEX®, NCLEX-RN®, NCLEX-PN®, and NCSBN® are trademarks of the National Council of State Boards of Nursing, Inc.
All in Plus LLC and NurseJames are independent educational services.
We are not affiliated with, sponsored by, endorsed by, approved by, or associated with NCSBN, Pearson VUE, or any state or territorial Board of Nursing unless expressly stated otherwise.
References to NCLEX are used only to identify the examination for which learners are preparing.
We do not knowingly reproduce, obtain, solicit, reconstruct, or distribute confidential questions or secure content from an actual NCLEX examination. NCSBN treats the NCLEX as a secure examination and maintains test-security requirements for candidates.
6. Accounts
You must provide accurate account information and keep it reasonably current.
Each individual learner account is intended for one person only unless we expressly provide institutional or multi-user access.
You are responsible for maintaining the confidentiality of your password, login credentials, and account.
You may not sell, transfer, lend, rent, sublicense, or share your account.
Notify us promptly at support@nursejamesnclex.com if you believe your account has been accessed without authorization.
7. Plans and enrollment access
Paid plans are purchased through All in Plus LLC on the pricing page. A free starter account needs no payment.
Unless expressly stated otherwise, each plan is personal to the learner purchasing it and may not be resold, transferred, duplicated, gifted, or shared.
We may suspend access that is fraudulently obtained, resold, improperly transferred, or misused.
Access may be granted for a specific period and may expire at the end of that period.
8. Fees and refunds
Some access may be free, promotional, institutionally sponsored, or paid.
Where a fee applies, pricing, access duration, currency, taxes, and other material payment terms will be disclosed before enrollment or purchase.
Unless otherwise required by applicable law or expressly stated in writing, payment for digital access is non-refundable once access has been activated or substantially delivered.
Nothing in these Terms eliminates a refund, cancellation, cooling-off, or consumer right that cannot legally be waived.
We may issue a refund if we charged you incorrectly, cannot provide paid access, terminate paid access for a reason unrelated to your conduct, or are required to do so by applicable law.
9. Exam Simulator and Readiness Exam
The Exam Simulator and Readiness Exam are educational preparation tools.
Scores, performance bands, readiness levels, readiness ranges, analytics, recommendations, focus areas, study priorities, and other results produced by the Service are not official NCLEX scores or predictions issued by NCSBN.
Terms such as "Developing", "Near Ready", "Ready", "Highly Ready", "Focus Area", or similar classifications are educational interpretations used by All in Plus LLC.
They are not guarantees that a learner will pass or fail the actual NCLEX examination.
10. Original All in Plus content
The Service contains substantial original material created, selected, edited, organized, filmed, recorded, commissioned, or developed by All in Plus LLC.
To the extent owned by or validly assigned or licensed to All in Plus LLC, this may include original questions, original question adaptations, rationales, teaching explanations, Study Guides, Review Cards, graphics, presentations, Video Lessons, lectures, Live Class materials, teaching scripts, study plans, educational frameworks, original compilations and selections, branding, logos, website copy, original photographs, interface content, proprietary databases, and related materials.
These materials may be protected by copyright, trademark, contract, trade-secret, and other applicable laws.
11. AI-assisted content
Certain materials available through the Service may have been created or developed with the assistance of artificial-intelligence tools, including ChatGPT by OpenAI.
AI tools may assist with drafting, editing, formatting, question concepts, draft rationales, educational explanations, summaries, examples, organization, or instructional development.
All in Plus LLC may review, edit, select, organize, supplement, verify, revise, clinically evaluate, and approve AI-assisted content before publication.
OpenAI's current Terms state that, as between the user and OpenAI and to the extent permitted by law, the user owns generated output, while also explaining that generated output may not be unique and that other users may receive similar output.
Accordingly, All in Plus LLC does not claim exclusive ownership merely over general facts, ideas, concepts, common phrasing, or material that may be independently generated in substantially similar form.
To the extent permitted by law, All in Plus LLC retains rights in its own original human-created and human-edited contributions, including selection, editing, arrangement, organization, commentary, explanations, videos, graphics, compilations, and instructional structure.
OpenAI and ChatGPT do not sponsor, endorse, or assume responsibility for All in Plus LLC or NurseJames.
12. Open educational resources and third-party materials
Some educational materials in the Service may be based on, adapted from, or incorporate lawful third-party resources, including Open Educational Resources, Creative Commons-licensed materials, public-domain materials, government resources, scholarly resources, or other appropriately licensed content.
All in Plus LLC does not claim exclusive ownership of third-party or openly licensed material merely because that material appears within the Service.
Ownership of such material remains with the applicable rights holder and is governed by the applicable license.
13. Open RN materials
Certain educational materials may be based on, adapted from, or incorporate content from Open Resources for Nursing ("Open RN").
Where Open RN material is made available under the Creative Commons Attribution 4.0 International License, CC BY 4.0 permits sharing and adaptation, including commercial use, provided the license requirements are followed. Those requirements include appropriate attribution, reference to the license, and an indication when changes have been made.
When All in Plus LLC uses or adapts CC BY 4.0 material, we will seek to provide the required attribution, identify the applicable license, indicate modifications where required, and avoid suggesting that the original creator endorses All in Plus LLC.
If particular Open RN material or third-party content carries a different copyright notice, license, or restriction, that specific notice or license governs that material.
Restrictions in these Terms relating to All in Plus LLC proprietary content do not override rights independently granted by an applicable open license.
14. Sources and attributions
All in Plus LLCmay maintain a Sources & Attributions, Open Educational Resources, or similarly titled page identifying significant third-party and openly licensed materials.
Where applicable, attribution may include the creator, source, title, copyright notice, license, license reference, source location, and an indication that modifications were made.
Users should consult applicable attribution notices before assuming that a particular item is exclusively owned by All in Plus LLC.
15. General nursing and medical knowledge
Many concepts addressed in NCLEX preparation involve general nursing, medical, pharmacological, scientific, or educational facts.
Generally known facts, established nursing principles, medication information, laboratory values, disease characteristics, clinical concepts, and commonly taught nursing principles may appear in educational resources created by multiple providers.
The appearance of similar factual subject matter does not by itself establish copying.
All in Plus LLC may independently create educational materials based on public information, standard nursing knowledge, general clinical principles, and independently researched subject matter.
16. Question bank integrity
Our question bank may contain:
- wholly original All in Plus LLC questions;
- independently developed questions;
- AI-assisted questions reviewed or modified by All in Plus LLC;
- questions adapted from lawfully licensed open educational resources;
- questions based on public-domain information;
- questions based on generally known nursing and medical concepts; and
- appropriately licensed third-party material.
All in Plus LLC does not knowingly reproduce proprietary questions from NCSBN, commercial NCLEX review providers, publishers, educational companies, or other third-party question banks without authorization. All practice questions are intended to be independently created, lawfully licensed, adapted from authorized open educational resources, derived from public-domain information, or developed from general nursing and medical knowledge.
We do not knowingly use questions obtained from an actual secure NCLEX examination.
If a rights holder believes a particular item infringes its copyright or other rights, the rights holder may contact us using the copyright procedure described below.
17. License granted to learners
While your authorized access remains active and subject to these Terms, All in Plus LLC grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use All in Plus LLC proprietary materials solely for your individual study and NCLEX preparation.
This license does not transfer ownership.
Except where permitted by law or an applicable open license, you may not reproduce, republish, redistribute, sell, sublicense, commercially exploit, or create unauthorized derivative products from All in Plus LLC proprietary materials.
18. Acceptable use
You agree not to:
- share, sell, rent, or transfer your account;
- systematically screenshot proprietary question-bank content;
- screen-record proprietary Video Lessons;
- record Live Class sessions without authorization;
- reproduce proprietary Study Guides, Review Cards, or rationales;
- upload proprietary All in Plus LLC materials to another website, app, question bank, file-sharing service, social-media platform, or educational service;
- sell or trade proprietary materials;
- scrape, crawl, or systematically extract Service content;
- use automated tools to obtain substantial amounts of proprietary content;
- bypass authentication, access controls, payment restrictions, or security controls;
- reverse engineer proprietary software except where applicable law expressly permits;
- introduce malicious code or interfere with operation of the Service;
- use proprietary All in Plus LLC materials to train, fine-tune, populate, benchmark, or evaluate an AI or machine-learning system without written authorization;
- remove copyright, attribution, trademark, or proprietary notices;
- use the Service unlawfully; or
- knowingly upload, reproduce, reconstruct, distribute, or solicit actual secure NCLEX examination items.
These restrictions supplement the protections already present in your current Terms regarding redistribution, scraping, machine-learning use, security circumvention, account sharing, and actual NCLEX examination content.
19. Video Lessons, lectures, and Nurse James content
Unless otherwise identified, original Video Lessons, recorded lectures, Live Class presentations, explanations, instructional commentary, scripts, graphics, presentations, demonstrations, and educational content created by Nurse James or All in Plus LLC are proprietary materials owned by or licensed to All in Plus LLC.
Authorized learners may view these materials only for personal educational use.
Without written permission, users may not record, reproduce, rebroadcast, republish, sell, distribute, publicly display, or commercially exploit such materials.
20. Software and website features
The Service may include software, database structures, interfaces, workflows, design elements, platform architecture, source code, and technology owned by All in Plus LLC or licensed from developers, open-source projects, or third-party providers.
Nothing in these Terms transfers ownership of the underlying software or platform technology to a learner.
Users may not attempt to obtain unauthorized source code, bypass restrictions, exploit vulnerabilities, decompile, reverse engineer, interfere with, or gain unauthorized access to the Service except where applicable law expressly permits.
21. User Content
If the Service allows users to submit messages, comments, questions, notes, testimonials, success stories, images, or other materials ("User Content"), users retain ownership of their User Content.
You grant All in Plus LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display User Content to the extent reasonably necessary to operate, support, and moderate the Service.
If you submit material for public marketing use, such as a testimonial, photograph, video, or success story, we may request separate consent where appropriate.
You must not submit protected patient health information, confidential employer information, confidential examination material, copyrighted material you are not authorized to share, unlawful content, threatening or harassing material, or another person's private information without permission.
22. Secure NCLEX examination content
You may not submit, request, solicit, reconstruct, reproduce, sell, distribute, post, or share questions that you know or reasonably believe were obtained from an actual secure NCLEX examination.
We may remove suspected secure examination content and suspend or terminate accounts associated with such conduct.
23. Copyright complaints
All in Plus LLC respects the intellectual-property rights of others.
If you believe material available through the Service infringes copyright that you own or are authorized to enforce, send written notice to our Copyright Contact at All in Plus LLC, by email to support@nursejamesnclex.com, with the subject line "Copyright Notice".
Your notice should include:
- your physical or electronic signature;
- identification of the copyrighted work claimed to have been infringed;
- identification of the allegedly infringing material;
- sufficient information for us to locate the material;
- your name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law; and
- a statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
These elements track the general requirements described by the U.S. Copyright Office for Section 512 copyright notices.
We may request additional information reasonably necessary to evaluate a claim.
24. DMCA procedures
Where applicable, we may respond to copyright notices under the Digital Millennium Copyright Act.
Section 512 provides conditional safe harbors for qualifying online service providers and includes specific notice-and-takedown procedures.
Unless and until All in Plus LLC formally registers a designated DMCA agent with the U.S. Copyright Office, our published copyright contact should be described as our Copyright Contact, not as a registered or designated DMCA agent.
If All in Plus LLC later registers a designated DMCA agent, this section may be updated with the agent information required by law.
25. Copyright disputes and mistaken claims
Receipt of a copyright complaint does not by itself establish ownership or infringement.
Where appropriate and consistent with applicable law, we may review information such as:
- authorship;
- original source materials;
- dates of creation;
- publication history;
- license terms;
- copyright registrations;
- open-license status;
- public-domain status;
- independent creation;
- modification history;
- contributor records; and
- other relevant evidence.
We reserve all rights and defenses available under copyright law, contract law, applicable licenses, and other law.
26. Content records and provenance
For quality assurance, licensing compliance, and intellectual-property protection, All in Plus LLC may maintain internal records identifying:
- question ID;
- source;
- author or contributor;
- date created;
- date imported;
- AI assistance where applicable;
- OER or Open RN source where applicable;
- license information;
- required attribution;
- modifications;
- clinical reviewer;
- revision history;
- approval date; and
- publication date.
These records may be used to evaluate quality, licensing, authorship, or copyright concerns.
27. Third-party services
The Service may rely on third-party providers for hosting, authentication, cloud storage, payments, analytics, email, communications, video conferencing, or other technology functions.
Third-party services are governed by their own terms and privacy practices.
Links to third-party websites are provided for convenience. We do not control and are not responsible for third-party websites or services that we do not operate.
28. Privacy
We handle personal information in accordance with our Privacy Policy and applicable law.
Because All in Plus LLC is based in California and may serve users internationally, privacy obligations may vary according to where a user lives.
Nothing in these Terms limits privacy or consumer rights that cannot legally be waived.
29. Security
You must not access another user's account, attempt unauthorized system access, defeat authentication controls, test vulnerabilities without written authorization, introduce malware, intentionally overload systems, or interfere with another user's use of the Service.
We use reasonable administrative and technical measures intended to protect the Service, but no internet-based system can be guaranteed completely secure.
30. Suspension and termination
We may suspend, restrict, or terminate access where reasonably necessary because of violation of these Terms, account sharing, unauthorized redistribution of proprietary material, fraudulent payment, chargeback abuse, security threats, harassment, misuse of Live Class, unauthorized extraction of content, unlawful conduct, or legal requirements.
Where appropriate and reasonably practical, we may provide notice.
When access ends, your license to use proprietary All in Plus LLC materials ends immediately.
Provisions relating to intellectual property, copyright, disclaimers, liability, indemnification, disputes, and provisions that by their nature should survive termination remain effective.
31. Service availability and changes
We may add, update, modify, replace, or discontinue features, content, instructors, schedules, layouts, question counts, classifications, or functionality.
We do not guarantee uninterrupted availability.
Temporary service interruptions may occur because of maintenance, updates, hosting failures, cybersecurity events, internet disruptions, third-party service failures, natural disasters, governmental action, or circumstances outside our reasonable control.
32. Accuracy of educational content
We strive to provide accurate, useful, and current educational materials.
However, healthcare information, nursing standards, medications, professional guidelines, licensing requirements, NCLEX test plans, and educational practices may change.
We do not guarantee that every item will always be free from error or immediately reflect every change.
If you believe an item contains a possible error, contact support@nursejamesnclex.com so it can be reviewed.
33. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE".
ALL IN PLUS DISCLAIMS WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT.
We do not guarantee that:
- the Service will always be uninterrupted or error-free;
- every educational item will be completely accurate;
- the Exam Simulator exactly reproduces the actual NCLEX;
- Readiness Exam results will predict an actual examination outcome;
- a candidate's actual NCLEX examination will stop at a particular number of questions;
- use of the Service will result in passing the NCLEX; or
- any particular professional result will occur.
Mandatory warranties and consumer protections that cannot legally be excluded remain unaffected.
34. Limitation of liability
To the maximum extent permitted by applicable law, All in Plus LLC and its owners, officers, employees, instructors, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Service.
This includes, where legally permissible, examination failure, delayed licensure, employment consequences, missed professional opportunities, loss of income, loss of data, inability to access the Service, or reliance on educational material.
To the fullest extent permitted by law, our aggregate liability for claims arising from or relating to the Service will not exceed the amount actually paid by the claimant to All in Plus LLC during the twelve months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
35. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless All in Plus LLCand its owners, officers, employees, instructors, and contractors from third-party claims, damages, liabilities, and reasonable legal expenses arising from your unlawful use of the Service, User Content you submit, content you provide without appropriate rights, infringement caused by your conduct, violation of another person's rights, or material violation of these Terms.
This obligation applies only to the extent permitted by applicable consumer law.
36. International users
The Service is operated from California, United States, but may be accessed internationally.
You are responsible for determining whether your use complies with laws applicable to you.
Nothing in these Terms is intended to remove mandatory consumer rights available under the laws of the country, state, province, or territory where you reside.
If a provision conflicts with mandatory consumer law applicable to you, that law controls only to the extent required.
37. Export controls and sanctions
The Service is operated from the United States and may be subject to U.S. export-control and sanctions laws.
You may not use the Service where doing so would cause All in Plus LLC to violate applicable U.S. sanctions or export-control requirements.
38. Governing law and disputes
Except where mandatory consumer law requires otherwise, these Terms are governed by the laws of the State of California and applicable federal law of the United States, without regard to conflict-of-law principles.
Subject to mandatory consumer rights, claims requiring court proceedings will be brought in an appropriate state or federal court located in California.
Before starting formal legal proceedings, we encourage users to contact us and make a reasonable effort to resolve disputes informally. Email support@nursejamesnclex.com or use our support page.
39. Changes to these Terms
We may update these Terms to reflect changes to the Service, new features, business changes, legal requirements, licensing requirements, or security considerations.
The "Last updated" date identifies the current version.
If a material change affects users' rights or obligations, we may provide notice by email, through the Service, through the website, or through another reasonable method.
Where permitted by law, continued use after revised Terms become effective constitutes acceptance of the revised Terms.
40. Assignment
You may not assign or transfer your account or rights under these Terms without our written permission.
We may assign these Terms in connection with a merger, acquisition, restructuring, financing, transfer of assets, or sale of all or part of the business, subject to applicable law.
41. Severability
If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the maximum legally permissible extent or severed, and the remainder of these Terms will remain effective.
42. No waiver
Failure to enforce any provision of these Terms does not waive our right to enforce that provision later.
43. No partnership, employment, or agency
Nothing in these Terms creates a partnership, joint venture, employment relationship, fiduciary relationship, agency, or professional nursing relationship between a user and All in Plus LLC.
44. Entire agreement
These Terms, our Privacy Policy, applicable enrollment terms, payment terms, attribution notices, and policies expressly incorporated into them constitute the agreement between you and All in Plus LLC concerning the Service.
